1. OBJECT
1.1. These Terms establish the general conditions for reserving Auper 600 CE model electric motorcycles, manufactured by Auper Brasil LTDA (“Auper”). Through these Terms, the Client obtains purchase priority for the referred product, without any purchase obligation on the part of the Client or sales obligation on the part of Auper.
2. WHAT ARE RESERVATIONS?
2.1. The reservation of the Auper 600 CE motorcycle guarantees priority at the moment sales are launched. Upon signing up, your name will be included in a single list, organized by order of registration.
2.2. Reservations will be organized by order of registration. The sooner the Client completes the reservation, the earlier they will have the opportunity to purchase a 600 CE.
2.3. The reservation does not create an acquired right to purchase, nor does it guarantee the availability or the final price of the product, serving solely to determine purchase priority at the moment sales are launched.
2.4. The Client is under no obligation to complete the purchase of the motorcycle and may cancel their reservation at any time before signing the purchase and sale agreement, under the conditions of these Terms.
3. RESERVATION PROCESS
3.1. Beginning of Reservations
3.1.1. Reservations for the Auper 600 CE models began on 04/01/2025. From this date, the Client must make a deposit of R$ 100.00 (one hundred reais) to guarantee their position in the priority queue.
3.1.2. After confirmation of payment, the Client will receive an email confirming their reservation.
3.2. Refundable Deposit
3.2.1. The deposit amount of R$ 100.00 is fully refundable, and the Client may request a refund at any time before signing the purchase and sale agreement.
3.2.2. Should the Client choose to proceed with the purchase, the deposit will be deducted from the final price of the vehicle.
3.2.3. If the Client requests a refund, the reservation will be automatically canceled, and they will lose their position in the priority queue. Should they wish to return at a later date, they will be placed at the end of the queue.
3.3. Payment Security
3.3.1. The deposit will be made via Stripe, an internationally recognized payment platform.
3.3.2. Stripe adopts strict security standards, including data encryption, strong authentication, and constant fraud monitoring, ensuring the protection of the Client's financial information.
3.3.3. By making the payment, the Client declares that they are aware of and agree with the terms and conditions of use of the Stripe platform, which are available on Stripe's official website.
4. RESERVATION CANCELLATION
4.1. The Client can cancel the reservation at any time before signing the purchase and sale agreement by sending an email to admin@aupermotorcycles.com, requesting the refund and cancellation.
4.2. The refund will be processed by Stripe and may take from 5 (five) to 10 (ten) business days to appear on the Client's bank statement, starting from the date of the refund confirmation on the platform.
4.3. If the Client does not receive the refund amount after 10 (ten) business days, they should contact Auper at admin@aupermotorcycles.com for investigation and support.
4.4. Upon cancellation and return of the deposit, the Client will automatically lose their position in the priority queue. In the event of a return, they will be repositioned at the end of the queue.
4.5. Auper reserves the right to cancel the reservation if the Client fails to comply with any of the terms established herein. In this case, the deposit amount will be fully refunded to the Client.
5. HOW DOES THE PURCHASE PROCESS WORK AFTER THE RESERVATION?
5.1. The reservation guarantees the Client a spot on a priority list. Auper will invite the Client to complete the purchase only when their turn in the queue is reached, following the order of priority.
5.2. At that moment, you will be able to choose the model you wish to purchase, based on the availability of the models and vehicle configurations.
5.3. Purchase confirmation will be subject to acceptance of the terms of the purchase and sale agreement, which will be sent to the Client at a later date.
5.4. The Auper team will be available to answer questions and offer support throughout the purchase completion and motorcycle delivery process.
6. GENERAL PROVISIONS
6.1. The reservation does not guarantee the final price of the motorcycle, which will be communicated to the Client at the time of signing the purchase and sale agreement, and may be altered according to Auper's commercial policy.
6.2. The Client declares that they are aware that the reservation does not imply any purchase or sale obligation.
6.3. The Client may choose to wait for the availability of a future model without losing their position in the priority queue, provided they do not request the cancellation of the reservation.
6.4. Auper may alter these Terms at any time and without prior notice. In the event of substantial changes, the Client will be notified by email or via a notice on the Auper website. The new version of the Terms will apply immediately.
6.5. Auper commits to adopting all appropriate measures to ensure the security of transactions carried out via Stripe and to protect the Client's personal and financial data.
6.6. The processing of the Client's personal data will be carried out in compliance with the General Data Protection Law (Law No. 13,709/2018), adopting technical and administrative measures to protect such data against unauthorized access and accidental or unlawful situations.
7. JURISDICTION AND APPLICABLE LAW
7.1. These Terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil.
7.2. The court of the Judicial District of Joinville/SC is elected to resolve any controversies arising from these Terms, to the exclusion of any other, however privileged it may be, subject to the provisions of consumer protection legislation.
8. CLIENT DECLARATION
By making the reservation, the Client declares that they have read, understood, and fully accepted the terms and conditions set forth in this document, recognizing that the reservation grants them only purchase priority, without creating any purchase obligation or acquired right to the product.
