1. SUBJECT
1.1. This Agreement sets forth the general conditions for the reservation of Auper 600 CE model electric motorcycles, manufactured by Auper Brasil LTDA (“Auper”). Through this Agreement, the Customer obtains priority to purchase the aforementioned product, with no obligation to purchase on the part of the Customer or to sell on the part of Auper.
2. WHAT ARE RESERVATIONS?
2.1. The reservation of the Auper 600 CE motorcycle will be your passport to secure priority in purchasing the desired model, whether the Founder’s Edition, the Extended Range version, or the Base Model. By signing up, your name will be included in a single list, organized in order of registration.
2.2. Reservations will be organized in order of registration. The earlier the Customer makes the reservation, the sooner they will have the opportunity to purchase the desired model.
2.3. The reservation does not create any vested right to purchase, nor does it guarantee the availability or final price of the product, serving only to determine the priority of choice and acquisition at the time sales begin.
2.4. The Customer is not obligated to complete the purchase of the motorcycle and may cancel the reservation at any time before signing the purchase and sale agreement, under the terms of this Agreement.
3. RESERVATION PROCESS
3.1. Start of Reservations
3.1.1. Reservations for the Auper 600 CE models will begin on 04/01/2025. From that date on, the Customer must make a deposit of R$ 100.00 (one hundred reais) to secure their place in the prioritization queue.
3.1.2. After payment confirmation, the Customer will receive an email confirming their reservation.
3.2. Refundable Deposit
3.2.1. The deposit amount of R$ 100.00 is fully refundable, and the Customer may request a refund at any time before signing the purchase and sale agreement.
3.2.2. If the Customer chooses to proceed with the purchase, the deposit will be deducted from the final price of the vehicle.
3.2.3. If the Customer requests a refund, the reservation will be automatically canceled, and they will lose their position in the prioritization queue. If they wish to return at a later time, they will be placed at the end of the queue.
3.3. Payment Security
3.3.1. The deposit will be made via Stripe, an internationally recognized payment platform.
3.3.2. Stripe adopts strict security standards, including data encryption, strong authentication, and constant fraud monitoring, ensuring the protection of the Customer’s financial information.
3.3.3. By making the payment, the Customer declares that they are aware of and agree to the terms and conditions of use of the Stripe platform, available on Stripe’s official website.
4. CANCELLATION OF RESERVATION
4.1. The Customer may cancel the reservation at any time before signing the purchase and sale agreement by sending an email to admin@aupermotorcycles.com, requesting a refund and cancellation.
4.2. The refund will be processed by Stripe and may take 5 (five) to 10 (ten) business days to appear on the Customer’s bank statement, starting from the date the refund is confirmed on the platform.
4.3. If the Customer does not receive the refunded amount after 10 (ten) business days, they must contact Auper by email at admin@aupermotorcycles.com for investigation and support.
4.4. Upon cancellation and return of the deposit, the Customer will automatically lose their position in the prioritization queue. In case of return, they will be placed back at the end of the queue.
4.5. Auper reserves the right to cancel the reservation if the Customer breaches any of the terms set forth herein. In such case, the deposit amount will be fully refunded to the Customer.
5. HOW DOES THE PURCHASE PROCESS WORK AFTER THE RESERVATION?
5.1. The reservation guarantees the Customer a place in the priority list. Auper will invite the Customer to complete the purchase only when the motorcycle is ready for delivery, following the priority order.
5.2. At that time, you will be able to choose the model you wish to purchase, based on model availability.
5.3. Confirmation of the purchase will be subject to acceptance of the terms of the purchase and sale agreement, which will be sent to the Customer later.
5.4. The Auper team will be available to answer questions and provide support throughout the entire process of completing the purchase and delivering the motorcycle.
6. GENERAL PROVISIONS
6.1. The reservation does not guarantee the final price of the motorcycle, which will be informed to the Customer at the time of signing the purchase and sale agreement and may change according to Auper’s commercial policy.
6.2. The Customer declares that they are aware that the reservation does not imply any obligation to purchase or sell.
6.3. The Customer may choose to wait for the availability of a future model without losing their position in the priority queue, provided they do not request cancellation of the reservation.
6.4. Auper may amend this Agreement at any time and without prior notice. In case of material changes, the Customer will be notified by email or through a notice on Auper’s website. The new version of the Agreement will apply immediately.
6.5. Auper undertakes to adopt all appropriate measures to ensure the security of transactions carried out via Stripe and to protect the Customer’s personal and financial data.
6.6. The processing of the Customer’s personal data will be carried out in accordance with the General Data Protection Law (Law No. 13,709/2018), adopting technical and administrative measures to protect such data against unauthorized access and accidental or unlawful situations.
7. JURISDICTION AND APPLICABLE LAW
7.1. This Agreement shall be governed by and interpreted in accordance with the laws of the Federative Republic of Brazil.
7.2. The court of the District of Porto Alegre/RS is hereby elected to resolve any disputes arising from this Agreement, to the exclusion of any other, however privileged it may be, subject to consumer protection legislation.
8. CUSTOMER STATEMENT
By making the reservation, the Customer declares that they have read, understood, and fully accepted the terms and conditions set forth in this document, acknowledging that the reservation grants only purchase priority, without creating any obligation to purchase or vested right to the product.
