Identification and scope

This Privacy Policy belongs to Auper Brasil LTDA, registered with the CNPJ under No. 55.762.059/0001-09, with address at Rua Dona Francisca, 8300, Bloco 4, Módulo 4A, Bairro Zona Industrial Norte, Joinville, Santa Catarina, CEP 89.219-600, Brazil ("Auper", "we", "us" or "our"). It describes how we collect, use, share, and protect the personal data of those who visit the website auper.com.br, register for the purchase priority reservation, communicate with us or, in the future, purchase our products (collectively, the "Services"), in compliance with the General Data Protection Law (Law No. 13.709/2018, "LGPD").

For the purposes of this Policy, "you" and "data subject" mean any natural person whose personal data we process under the terms described herein, whether you are a customer, a website visitor, or another person in that capacity.

1. Changes to this Policy

We may update this Policy from time to time, including to reflect changes in our practices or for operational, legal, or regulatory reasons. We will post the revised version on the Website and update the "Last updated" date. Material changes will be communicated with additional prominence, via email or notice on the Website.

2. Personal data we collect

2.1. Data you provide directly to us, which may include:

  • Contact details: name, address, telephone number, and email address.

  • Reservation and order details: name, billing address, delivery address, payment confirmation, email address, and telephone number.

  • Account details: username, password, and information used for account security, where applicable.

  • Customer service details: the content of your communications with us, for example when contacting us by email or through social networks.

Some features of the Services may require you to provide us with certain data directly. You may choose not to provide them, but this may prevent you from using such features.

2.2. Data we automatically collect about your use of the Website ("Usage Data"), through cookies, pixels, and similar technologies, including device and browser information, network connection data, IP address, and other access logs to our application, in addition to how you interact with the Website.

2.3. Data we obtain from third parties, including:

  • Technology providers that support the Website and Services.

  • Our payment processors, such as Stripe, who collect payment data (for example, bank account or card details) to process your reservation or purchase.

  • Third-party tracking technologies when you interact with our emails, advertisements, or the Website.

Any data obtained from third parties is treated in accordance with this Policy.

3. How we use your personal data and the legal basis for each use

We only process your personal data when there is a legal basis for doing so, in accordance with Article 7 of the LGPD, for the following purposes:

  • Providing the Services and fulfilling our contract with you, including processing your reservation, processing payments, sending notifications about your account or order, organizing delivery, and managing exchanges and returns. Legal basis: execution of a contract or preliminary procedures to it (art. 7, V, of the LGPD).

  • Marketing and communications. We may send promotional communications via email, text message, or other channels, and personalize advertisements based on your interest in our products. Legal basis: your consent, which can be revoked at any time, or our legitimate interest in maintaining contact about products and services similar to those you have already shown interest in, always with the option for you to unsubscribe immediately (art. 7, items I and IX, and art. 10 of the LGPD).

  • Security and fraud prevention. We use your data to detect and prevent fraudulent, illegal, or malicious activities. Legal basis: our legitimate interest in keeping the Website secure for you and other users (art. 7, IX, and art. 10 of the LGPD).

  • Customer support and service improvement. We use your data to respond to you and improve the Services. Legal basis: execution of a contract and our legitimate interest in maintaining an effective relationship with you (art. 7, V and IX, of the LGPD).

  • Compliance with legal and regulatory obligations. Legal basis: art. 7, II, of the LGPD.

When we rely on legitimate interest, we previously assess whether this interest does not override your fundamental rights and freedoms, as guided by the ANPD's Guidance Guide on Legitimate Interest.

4. Cookies

We use cookies and similar technologies to remember your preferences, understand how you use the Website, and improve our Services. Most web browsers automatically accept cookies, but you can remove or block them in your browser settings. Blocking cookies may negatively affect some functionalities of the Website.

5. How we share personal data

We may share your personal data with:

  • Suppliers and service providers acting on our behalf, such as payment processors, technology providers, data analytics, customer service, cloud storage, and logistics.

  • Business and marketing partners, who will use your data in accordance with their own privacy notices.

We do not share sensitive personal data, and we do not process your data for the purpose of inferring sensitive characteristics about you.

The Website may contain links to third-party websites or platforms. We recommend that you review the privacy policy of these third parties before providing any data to them. We are not responsible for the privacy practices of websites that we do not operate.

7. Children and teenagers' data

The Services are not intended for direct use by children and teenagers without the supervision of a guardian, and we do not intentionally collect children's data outside of what is provided for in this section.

In accordance with Article 14 of the LGPD and the Statute of the Child and Adolescent (Law No. 8,069/1990), the processing of data from children (under 12 years old) depends on the specific and highlighted consent of at least one of the parents or legal guardians, always in the best interest of the child. The processing of data from teenagers (between 12 and 18 years old) observes the same principle of best interest, considering their stage of development.

If you are responsible for a child or teenager who has provided us with personal data without proper authorization, please contact us at admin@aupermotorcycles.com to request deletion.

8. Security, retention and security incidents

We adopt technical and administrative measures to protect your personal data against unauthorized access and accidental or unlawful situations of destruction, loss, alteration, communication, or dissemination. No system is completely secure, and we recommend that you do not send us sensitive data through insecure channels.

We keep your data for the time necessary to fulfill the purposes of this Policy, meet legal or regulatory obligations, resolve disputes, and enforce our agreements, and we delete or anonymize them when these purposes end. As an internet application provider, we also observe the obligation to keep access logs provided for in Law No. 12,965/2014 (Brazilian Civil Rights Framework for the Internet).

In the event of a security incident that could pose a relevant risk or harm to you, we will notify the National Data Protection Authority and the affected data subjects, as required by Article 48 of the LGPD.

9. Your rights as a personal data subject

In accordance with Article 18 of the LGPD, you can request, at any time:

  • Confirmation of the existence of processing of your data.

  • Access to the personal data we hold about you.

  • Correction of incomplete, inaccurate, or outdated data.

  • Anonymization, blocking, or deletion of unnecessary, excessive, or data processed in non-compliance with the LGPD.

  • Portability of your data to another service provider, subject to commercial and industrial secrets.

  • Deletion of personal data processed based on your consent.

  • Information about public and private entities with which we share your data.

  • Information about the possibility of not providing consent and about the consequences of such refusal.

  • Revocation of your consent, when this is the legal basis for the processing.

  • Review of decisions taken solely based on automated processing of your data, in accordance with Article 20 of the LGPD.

To exercise any of these rights, contact our Data Protection Officer at admin@aupermotorcycles.com. We may request additional information to confirm your identity before fulfilling the request. Requests for confirmation of processing and access will be answered within 15 (fifteen) days, in accordance with Article 19 of the LGPD; other requests will be met within a reasonable time.

10. Complaints

If you have any complaints about how we process your personal data, contact us first at admin@aupermotorcycles.com. You also have the right to file a complaint directly with the National Data Protection Authority (ANPD), available at gov.br/anpd.

11. International data transfer

We may transfer, store, and process your personal data outside of Brazil, including through international partners and service providers. When this occurs, we will carry out the transfer based on one of the hypotheses of Article 33 of the LGPD, adopting the safeguards required by the ANPD's International Data Transfer Regulation (Resolution CD/ANPD No. 19/2024), such as standard contractual clauses approved by the authority, or another mechanism recognized by it.
